Baldi Looks for Dismissal

A Des Moines attorney says prosecutors don't have a case against his client, who is accused of involuntary manslaughter in the drug overdose deaths of ten of his former patients.

Guy Cook says he asked a Polk County judge to dismiss the charges.

Cook says the state overreached in charging Dr. Daniel Baldi with overprescribing prescription painkillers to people who later died of drug overdoses. Prosecutors argue the charges are valid.

Among the former patients who died was the co-founder of the rock group Slipknot, Paul Gray. Gray died in may of 2010 of an overdose at an Urbandale hotel.

Polk County District Court Judge Gregory Brandt will issue a ruling later.
